se invece andiamo cercando dell’hardware untrusted, possiamo contare solo su Lemote Yeeloong qualcuno mi disse che era solo tempo perso, dunque le chiacchiere stanno a zero, mentre solo nel 2008 si sono aggiunte 12 hardware houses.

Essedi vende computers desktop/tower con GNU/linux, ma per i notebooks, non c’è nulla da fare, li vende solo con winzozz, sta a voi farvi sentire per ottenere un rimborso, per quanto riguarda winzozz vista, dato che non c’è alcuna clausola per il rimborso, sta a voi all’atto dell’acquisto, rifiutare di averlo, se non direte nulla in proposito, darete per scontato il tacito assenso, così come da codice civile.

Un contratto nel 90% dei casi deve essere stipulato fra le due parti, quando viene imposto, sta a voi dire che rifiutate di accettare tale contratto e quindi vi dovranno rimuovere winzozz e/o rimborsarvi o farvi un buono acquisto per altro materiale. http://www.essedi.it sales@essedi.it 800990055

Quando si sente parlare di produttori di portatili, nella maggior parte dei casi, si pensa subito a marchi come Dell, Hewlett-Packard o Toshiba. In verità si tratta di OEM, ovvero di Original Equipment Manufacturer, quindi di società che assemblano prodotti di fabbricazione altrui. I veri rapporti di forza, a livello mondiale, si giocano fra gli ODM, ovvero gli Original Design Manufacturer – coloro che realmente realizzano l’hardware da rimarchiare.

Secondo l’ultima indagine di Research and Markets dietro a grandi brand si nascondo non poche sorprese. Ad esempio, nel 2006 Hewlett-Packard ha conquistato la leadership mondiale nelle vendite dei portatili con il 20%; l’aspetto curioso è che il re degli ODM è la semi-sconosciuta Quanta con il 33% del segmento. In pratica un portatile su tre presente sul mercato, in verità, è prodotto da un’unica azienda. I cinque più importanti ODM del globo detengono l’86,6% del mercato, e sono: Quanta, Compal, Wistron, Inventec e Asus. Nel 2006 Qaunta ha venduto 24 milioni di unità, mentre Compal “solo” 15 milioni conquistando il 21% di share. Wistron, Inventec e Asus, invece, non sono andate oltre rispettivamente le 11 milioni (15%), 7 milioni (10%) e 5 milioni di unità (7%).

Vagando un pò alla ricerca di hardware compatibile con GNU/linux mi sono imbatutto in Airone : società di Padova che ha come scopo la diffusione di tecnologia hardware e software basata su Linux e tecnologie Open Source.

* CD del solo sistema operativo (se fornito in origine da Acer), ad esclusione dei CD di Norton Antivirus e di eventuali altri software concessi con licenza Trial o in uso gratuito

* Copia del documento d’acquisto del prodotto (la richiesta di rimborso non può essere accettata se la stessa avverrà dopo che siano trascorsi 30gg dalla data d’acquisto).

Il tutto dovrà essere spedito presso il Centro Assistenza Acer indicatole dall’operatore del Call Center, al fine di consentire la rimozione del sistema operativo Microsoft e di procedere al rimborso.

Il rimborso sarà effettuato entro 5 giorni lavorativi dalla ricezione del materiale di cui sopra presso il nostro Centro Assistenza.

La informiamo inoltre che:

* I costi di spedizione del prodotto da e per il Centro Assistenza Acer saranno a suo carico.

Ho scritto nuovamente alla ProStar chiedendogli gentilmente di cambiare la form e di inserire un campo vuoto affinchè si possa beneficiare del rimborso di windows di $70.00, di darci 2 anni come previsto dalle vigenti leggi italiane, bisogna dire però che oltre a dare un periodo di garanzia di 1 anno, consentono l’estensione a 3 anni pagando poco meno di $ 50.

FreeBSD developer sues Lenovo over Windows license refund refusal

In a complete contrast to a few weeks ago when Amazon gave a customer an 11% discount http://www.geek.com/articles/news/amazon-customer-returns-windows-gets-11-asus-netbook-discount-20090724 for not wanting Windows on a netbook, a Danish FreeBSD developer is suing Lenovo for refusing a similar refund.

The developer is Poul-Henning Kamp and the lawsuit has been filed in Denmark.

On August 10th Poul bought a Lenovo T400s which was supplied with Windows Vista Business edition.

On first boot the usual Windows license appears asking the user to agree and includes the following passage:

By taking the software in use, you agree to these terms.

If you do not accept the conditions, you have no right to use the software.

Contact the manufacturer who installed the software to get information on how to get reimbursement for the purchase or a credit note.

As Poul will be using the laptop for FreeBSD he did not require Windows and therefore contacted Lenovo for a refund.

The response he got was that Lenovo would not issue a refund just for the operating system as it is sold as a package with the laptop, but they would give a refund for the entire machine.

Poul is now suing Lenovo for the cost of the license arguing that Lenovo’s decision not to refund is in conflict with what it states on the Windows license on the machine.

He also wants the company to clearly state on its website that buying any laptop preinstalled with Windows comes with the choice of getting a refund for choosing not to use Windows.

Matthew’s Opinion

In this day and age where you can go on to a website like Dell and choose everything in fine detail, from the processor and memory to the color of the laptop casing, is amazes me that the option of an operating system is still so backwards.

I have encountered a similar frustration recently where I attempted to get Acer to agree a refund on a preinstalled OS.

They refused at first, so I pointed them to the Windows license agreement, after a few e-mails they agreed, but then stated that the machine would have to be shipped to them to have the OS removed costing me more than the refund was worth.

Acer lost my business as I thankfully did this check before buying the machine.

I hope Poul sees some success with his lawsuit as everyone should be given a choice in the operating system they use.

Just because the majority of people select Windows doesn’t mean you can make it difficult not to use it.

The whole setup is there because it is easier for the manufacturers to preinstall than to wait for the user to select an OS.

Operating system choice remains the one choice users do not seem to have on a new laptop unless they pay for Windows and then uninstall it, or fight for a refund.

There are a few cases where Linux laptops are available, but they aren’t as widespread as they should be.

How about supplying machines without an OS and including a Windows installation disc instead?
That would be easier for everyone and most users would likely still choose Windows.
